Court Ruling Does Not End Mall Battle
There has been a recent swirl of information concerning the latest court
ruling by NY State Supreme Court Justice Jeffrey Spinner and an ensuing
buzz in the community on what it all means in relation to the fate of
the proposed mall on the former Cerro Wire site in Syosset.
While the outcome of the court decision was not unexpected, it is
important to note that this ruling does not in any way, shape or form
mean the mall is being built any time soon, if ever. The next step
involves an appeal by the Town of Oyster Bay and the local civic
associations before the Appellate Court seeking to reverse Judge
Spinner’s decision. After that, there is also the Court of Appeals, the
State's highest court, beyond whatever happens in the Appellate Court.
In the end, we are confident our legal position against the mall will
prevail.
In the meantime, any talk that construction of the mall will begin soon
is nothing more than another scare tactic being propagated by the
Taubman forces who, as you know, have tried numerous times to make it
appear that the building of the mall is imminent. Rest assured, the
resolve of the Cerro Wire Coalition and the Alternate Development
Committee is stronger than ever to continue its fight against the mall,
as it has successfully for the past 13 years and counting.
